Our team gets asked this question a lot. In short, yes. You are not required to be represented by a lawyer or Registered Migration Agent for any kind of application. Many people find the process easy enough to successfully navigate.
That said, Australia’s immigration laws, policies and procedures are complex and often overwhelming. As is the nature of law, immigration law changes constantly and is subject to regular and oftentimes unexpected change. This is a key benefit of a representative – they are obligated to constantly refresh their knowledge and stay on top of the changes to laws, policies and procedures on behalf of their clients. Unless you’re a trained expert, it’s very hard to kick a goal when somebody keeps moving the goalposts.
We are often asked if a representative can speed up the processing time of an application. Processing times are up to the Department, but having a representative often means that your application is fully documented, which may lead to a shorter processing time. They also identify any potential risks in your application before lodgement, which minimises delays.
Ultimately, it’s up to you. It’s a bit like deciding whether to use an accountant or tax agent to do your tax return – do you have the time and appetite to deal with complex laws and bureaucracy, and are you sure you can get the best return? If so, that’s great! For many, however, they aren’t willing to leave anything to chance.
