The new National Innovation Visa (‘NIV’) (subclass 858) is a permanent visa aimed at foreign nationals with a proven record of international recognition in their field. It has been introduced to attract highly talented individuals who can boost productivity, create new jobs, and drive growth in key sectors of the Australian economy.
What constitutes ‘international recognition’?
For nomination purposes, what qualifies as ‘international recognition’ will vary by state and territory, as well as by the specific pathways offered in each. There is no single checklist that applies across the board. However, to be considered for nomination, individuals must demonstrate credentials and significant achievements that are likely to translate into economic or reputational benefits for Australia.
Examples of supporting evidence may include (but are not limited to):
- Receiving one or more prestigious international awards
- Delivering keynote addresses or holding global leadership positions
- Holding intellectual property rights or demonstrating successful commercialisation
- A proven record of innovation or entrepreneurship
- Prestigious creative or sporting achievements recognised globally, enhancing Australia’s international standing
- Holding a PhD with substantial academic influence or thought leadership history
Who can apply?
While all states and territories follow the overarching criteria set by the Department of Home Affairs (‘DHA’), each has its own emphasis and pathway categories.
In NSW, five distinct pathways are available for individuals:
- Entrepreneurs with a unique vision and the ability to generate prosperity
- Sports professionals who have competed at the highest international levels
- Researchers and academics whose work has global impact
- Innovative investors who contribute to priority business sectors
- Creative professionals whose work defines culture and expands the arts
In South Australia, the five available pathways are:
- Entrepreneurs
- Global researchers & thought leaders
- Innovative investors
- Creative talent
- Other globally talented individuals
Currently, Victoria follows a broader approach, identifying eligible individuals as those with exceptional achievements in:
- A profession
- A sport
- The arts
- Academic & research
What is the process?
The application process is broken down into 4 distinct stages:
Stage 1: To be eligible, an individual will need to first be identified by a state or territory as internationally recognised in their field for outstanding achievement and expertise, and as an individual whose skills will be beneficial to the state or territory if they are invited to apply for the NIV.
Stage 2: A state or territory government wishing to nominate an individual will submit a nomination document in support of the individual. This will act like a letter of recommendation as an individual moves on to the next stage of their journey towards the NIV.
Stage 3: With state government support, an individual may then submit a Registration of Interest (‘ROI’) if nominated by NSW or South Australia, or an Expression of Interest (‘EOI’) if nominated by Victoria to the DHA. Once submitted, ROIs and EOIs cannot be amended and must be complete and correct at the time of lodgement. Each state or territory sets its own specific conditions for the ROI or EOI submission process. In NSW, for example:
- Only one ROI can be submitted per individual in a 6-month period; and
- Shortlisted candidates will have 21 days to submit their full application.
Stage 4: After considering an individual’s application, the DHA may then invite the individual to apply for the visa.
The pathway is highly selective and involves a rigorous, multi-stage process that demands not only exceptional credentials but also a strategic and thoroughly prepared application.
